SCA’s Guidelines on Enabling Technologies

The Securities and Commodities Authority (SCA), in collaboration with the Central Bank of the UAE, Dubai Financial Services Authority (DFSA), and the Financial Services Regulatory Authority (FSRA), has released a unified set of guidelines to help financial institutions adopt enabling technologies in a secure, responsible, and compliant manner.

APIs, cloud computing, biometrics, artificial intelligence (AI), big data analytics, and distributed ledger technology (DLT) are the fundamental solutions that bring about the magic of technology; however, they are also the cause of the inherent risks that can be tackled through quality governance and vigilant oversight.

There are five basic principles in the structure: guarantees for data protection, secure methods of internal control, conduct of independent audits, forfeiture of skilled staff, and commitment to continuous training courses. The institutions need to ensure that new technology adoptions are in line with legal norms and the risk appetite they have internally.

For the APIs, the primary thing is to design, monitor, and control the life cycle of the security. When it comes to cloud computing contracts, one must take into account materiality, auditability, data protection, and business continuity, and provision for clear exit strategies.

When it comes to biometrics, organizations are supposed to take care of personal information along the whole identity lifecycle, starting from enrollment and up to authentication. Relating to AI and big data, the point of stress consists in transparency, fairness, and accountability—meaning models are not only ethical, explainable, and continuously controlled to avoid bias or unintended outputs.

DLT’s related applications require the presence of secure consensus protocols, clear governance, and non-anonymity in permissionless systems, in order to have a trustworthy regulatory framework.

The regulations will be applicable to all registered financial institutions in the UAE and are designed to keep a balance between the innovation motive and the privacy of customers, the system integrity, and the financial stability. They recommend that financial companies come up with effective board oversight mechanisms, do frequent risk evaluations, and keep audit trails for regulatory obligations.
